SCHAUMBURG, Ill., July 1 -- InstallShield® Software Corporation today announced it has filed a lawsuit in U.S. District Court
against Wise Solutions, Inc. for electronic espionage, misappropriation of trade secrets, and copyright infringement. [...] InstallShield is seeking injunctive relief and damages in excess of two million dollars.

Specifically, the complaint charges Wise with violating the Digital Millennium Copyright Act, the Computer Fraud and Abuse Act, the Illinois Trade Secrets Act, as well as engaging in copyright infringement. For at least ten months, Wise obtained unauthorized access to InstallShield's FTP servers and downloaded almost 1,000 highly confidential records, including proprietary beta software, trade secrets and copyrighted publications. InstallShield discovered Wise's electronic espionage after Wise sent suspicious marketing materials to several unique "decoy" contacts that were included on InstallShield's proprietary customer lists. InstallShield is cooperating in an ongoing criminal investigation into Wise's actions by the Federal Bureau of Investigations and the United States Attorney's office in Chicago. [...]

The suit was filed Friday, June 27, 2003 at United States District Court, Northern District of Illinois, Eastern Division.


According to PR Newswire, the source of this information is InstallShield Software Corp. However this lawsuit is currently not mentioned on the installshield.com web site.

I use both company's products, so it will be interesting to see what becomes of this lawsuit.

Wise Solutions Inc. have not yet replied to my request for a comment about this matter. However Chicago newspaper Daily Herald quote Pat Ziarnik, Wise's chief legal officer, saying that Wise does not believe the charges are true, and will investigate internally.

InstallShield Obtains Court Order against Wise Solutions

SCHAUMBURG, Ill., July 8, 2003 -- InstallShield® Software Corporation today announced that on July 2, 2003, The United States District Court for the Northern District of Illinois, Eastern Division issued an Agreed Order prohibiting Wise Solutions, Inc. from using information and intellectual property obtained from InstallShield's computers.

Specifically, the order prohibits Wise from obtaining further access to InstallShield's computers; using any proprietary information, intellectual property or copyrighted information obtained from InstallShield's computers; and further use of any InstallShield trade secrets identified in InstallShield's Verified Complaint.

"Our objective in this litigation is to protect our intellectual property and promote fair, open competition, and we are pleased the Court has acted quickly to protect these rights," said Viresh Bhatia, CEO and co-founder of InstallShield. "The Agreed Order issued by the Court is an important step in maintaining the quality and innovation our customers associate with InstallShield software and protecting the Intellectual Property that we have worked so hard to create over more than 10 years."

Still no comment from Wise Solutions.
